Distance Service Agreement

Parties and formation

The provider is To be verified before live sales; the customer is the person identified in the reservation form who declares they are at least 18. The purchaser declares that they are at least 18, are authorized to act for themselves or the listed guests, and have supplied accurate information. The agreement is formed electronically when the clearly labelled payment obligation is completed.

Subject and price

The agreement covers the daily boat tour for the date and guest counts shown in the order summary. Unit prices, quantities and the tax-inclusive total are stored in the reservation-specific record.

Performance and confirmation

• Payment is verified server-side by the provider/bank; a browser success screen alone is not final proof of payment.
• The reservation becomes final after full payment and operational approval.

Responsibilities

• Guests must be at the stand by 09:45 for boarding. Joining after departure or delaying the vessel cannot be guaranteed.
• The declared guest and age distribution may be checked on the tour day. Materially incorrect information may require a price adjustment, operational review or refusal of boarding.
• Online requests may be reviewed against current capacity, total party size and the daily operation plan. Team approval is required before payment for requests that need operational review.
• The captain may change the route, stop order and durations for weather, sea, safety or authority decisions. A material failure to provide the tour is assessed separately from a route-order change.

Cancellation, refund and withdrawal

• If the customer submits a written cancellation request at least 24 hours before the scheduled departure, the full service fee is refunded. For cancellations made less than 24 hours before departure, no refund is made for the reserved capacity, without prejudice to mandatory statutory rights.
• Date-change requests must be submitted at least 24 hours before departure. A change is subject to capacity on the requested date and acceptance of any current price difference; where unavailable, the cancellation and refund terms apply.
• If the operator cancels the tour entirely or performance becomes impossible, the customer is informed within three days. The customer is not required to accept an alternative date; the amount collected is refunded within 14 days of notification, to the original payment method where legally and technically possible.
• A complete cancellation due to weather, sea, safety or an authority decision is governed by the operator-cancellation terms. If a material programme change occurs before the tour starts, the customer may accept it or cancel before performance and request a full refund.
• Any refundable amount is returned to the original payment method within 14 days of the refund decision or impossibility notice. The bank or payment provider may require additional time to reflect the amount after that.
• The reservation concerns a leisure service supplied on a specific date. The 14-day withdrawal right does not apply under the exception in Article 15 of the Turkish Distance Contracts Regulation. This exception does not remove the operator’s customer-friendly cancellation policy, mandatory consumer rights or refunds where the service is not supplied.

Retention and disputes

• Reservation-specific pre-information, the distance service agreement, acceptance record and order confirmation are retained for at least three years from the transaction date. The customer may access and download them through the private reservation link during this period.
• Requests and complaints may be submitted through the email, phone or registered e-mail channels shown on the commercial information page.
• Consumers may apply to the competent Turkish consumer arbitration committee or consumer court subject to applicable jurisdiction and monetary limits.
